Terms of use of the site and sale of DeviceUA products

General provisions

These Terms of Use regulate the procedure for using the DeviceUA website, placing orders, payment, delivery of goods, warranty claims, return and exchange of goods, as well as interaction between the buyer and the seller.

By placing an order on the website or through other store communication channels, the buyer confirms that he has read these terms and conditions, fully agrees with them and accepts them without any reservations.

The seller of goods is an individual entrepreneur (FOP) who carries out sales and, in some cases, intermediary activities in the supply of electronic devices.

DeviceUA store has the right to change, supplement or update these terms and conditions without prior individual notification to users. The current version of the terms and conditions is posted on the website and applies from the moment of its publication.

Nature of the goods

The DeviceUA store specializes in selling electronic vaping devices, batteries and cartridge devices, vaporizers, empty disposable devices, accessories for electronic devices, and other compatible technical solutions.

All devices are sold without any filling.

The store does not sell liquids, nicotine products, refill cartridges, or any substances.

DeviceUA sells exclusively technical devices and equipment. The buyer is solely responsible for the further use of the purchased equipment. The store does not control and is not responsible for the way the devices are used after sale.

Buyer's age

By placing an order, the buyer confirms that he has reached the age of majority, has sufficient civil capacity and has the right to make purchases in accordance with the laws of his country.

The store has the right to refuse to fulfill the order, suspend order processing, or cancel the placed order without explaining the reasons if there are doubts about the buyer's age, the legality of the purchase, the reliability of the data provided, or the good faith of the buyer's intentions.

Terms of order

The order can be placed through the website, via messengers, or through other store communication channels.

Sending an order or notification of intention to purchase a product does not mean automatic acceptance of the order for execution. The order is considered accepted only after confirmation by the store.

After placing an order, the buyer agrees that the characteristics of the product may differ slightly from the images, the color, design or packaging may be mixed or random, and the supplier may change the package, labeling, individual design elements or packaging design without notice.

Photos of products on the site are for informational purposes only and do not guarantee the complete visual or technical identity of a specific item of product.

Intermediary nature of the activity

In some cases, DeviceUA acts as an intermediary between the buyer and the supplier.

In such cases, the store coordinates the ordering process, organizes interaction with the manufacturer or supplier, monitors the delivery stages, maintains communication between the parties, and, if possible, performs a basic inspection of the goods upon receipt.

For wholesale orders, the product may be sent first to the store for inspection or sent directly from the supplier to the buyer.

The estimated delivery time in such cases is 2-3 weeks, but may vary depending on logistical conditions, customs procedures, carrier workload, international conditions, and other circumstances beyond the control of the store.

The buyer agrees that DeviceUA is not the manufacturer of the goods, does not control all stages of production, and cannot guarantee the complete absence of manufacturing defects, deviations in batches, changes in appearance, packaging, assembly, or labeling by the supplier.

Payment terms

Payment can be made to the account of the individual entrepreneur, by cash on delivery or by other methods agreed upon by the parties.

For wholesale orders or orders formed for a specific buyer, a standard scheme may apply: 50% prepayment when placing the order and 50% payment after the store receives the goods and conducts a basic inspection or at another separately agreed stage.

Payment of the prepayment means the buyer's full agreement with the terms of the order, including the model, quantity, delivery format, estimated delivery times, technical features of the product, warranty conditions, and rules for considering possible claims.

If the goods are reserved, purchased, imported or ordered specifically for the buyer, the prepayment is considered a security for the fulfillment of the agreements by the buyer and is refundable only in cases expressly provided for by law or separately agreed in writing by the parties.

Delivery

Delivery of goods is carried out by Nova Poshta, international logistics companies, or directly from the supplier.

DeviceUA is not responsible for delays of carriers, customs procedures, actions or inaction of logistics companies, as well as for damage, loss or delay of goods during transportation after the shipment is handed over to the delivery service, unless otherwise expressly provided by law.

In case of loss or damage to the cargo due to the fault of the carrier, claims are considered in accordance with the rules of the logistics company. The store may facilitate communication with the carrier, but does not bear separate financial responsibility for its actions.

International delivery

In the case of international delivery, the product may be shipped directly from the manufacturer, supplier, or logistics partner, including from China, EU countries, or other jurisdictions.

The buyer agrees that international delivery times are approximate, customs authorities may detain, inspect or refuse the goods, and additional duties, taxes, fees, clearance fees or other related costs may arise.

All customs duties, taxes, fees and costs incurred during international importation are the responsibility of the buyer unless otherwise expressly agreed by the parties.

DeviceUA is not responsible for customs restrictions, customs delays, decisions of government authorities regarding the passage of goods, additional inspections, seizures, returns, or other actions of government authorities beyond the control of the store.

Product inspection

Upon receipt of the goods, the store can perform a basic inspection, including checking the quantity, checking the models, the external condition, and checking the charge indication.

This check is not a complete technical diagnosis of the device, is not a check of all operating modes, is not a long-term testing of the resource, and does not guarantee the absolute absence of hidden defects or unstable operation of individual units of the product in the future.

Warranty conditions

In the event of a defect being detected, the buyer is obliged to provide a photo or video recording of the defect, packaging, labeling, and, if necessary, the process of inspecting the goods without undue delay.

The decision on product replacement, partial compensation, refusal or other method of settlement is made in accordance with the warranty policy of the supplier, manufacturer or taking into account the actual circumstances of the specific case.

The store has the right to request additional materials, clarifications, unboxing videos, serial numbers, or other evidence necessary to consider the application.

The warranty does not cover mechanical damage, traces of use, improper operation, overheating, liquid ingress, improper connection, improper charging, interference with the device's design, independent repairs or modifications, natural wear and tear, as well as defects caused by the actions of the buyer, third parties, or the carrier.

Return and exchange of goods

Return and exchange of goods are carried out in accordance with the current legislation of Ukraine. The Civil Code of Ukraine provides that the list of goods that are not subject to exchange or return on appropriate grounds is established by regulatory legal acts, and as of March 2026, the database of the Verkhovna Rada contains both the Law of Ukraine "On Protection of Consumer Rights" No. 3153-IX with the status of "entering into force", and the Resolution of the Cabinet of Ministers No. 1243 dated 01.11.2024 on approving the list of goods that are not subject to exchange (return).

Given the nature of the products being sold, as well as the technical sensitivity of such goods, goods of proper quality may be accepted for consideration for exchange or return only on condition that they have not been used, their retail condition, complete set, packaging, seals, factory protective elements are preserved, and there are no traces of operation, connection, charging, damage or interference.

The store has the right to refuse to return or exchange goods of proper quality if the goods have traces of use, the packaging, seals, markings or protective elements are broken, part of the package is missing, the appearance is damaged, the goods were supplied under an individual order, special purchase, separate import or a personally agreed batch, or if return or exchange is not provided for by law or the nature of the agreements between the parties.

Limitation of liability

The DeviceUA store is not responsible for the method of using the purchased devices, the use of equipment with substances or materials, the circulation of which may be restricted by law, any consequences of using the goods after they are transferred to the buyer, as well as for indirect damages, loss of profit, loss of customers, reputational losses or other indirect consequences of using or inability to use the goods, unless otherwise expressly established by mandatory provisions of law.

The buyer is solely responsible for compliance with the legislation of his country, as well as for the legality of the use, storage, transportation or import of the purchased goods.

The buyer understands and agrees that electronic devices in this segment are technically sensitive goods that are mass-produced, and individual batches may contain a certain percentage of factory defects or unstable units. DeviceUA does not guarantee a zero percentage of defects in batches and is not responsible for hidden manufacturing defects if they could not be detected during a basic inspection or do not directly depend on the store's actions.

Right to refuse to fulfill an order

The store reserves the right to refuse to fulfill the order, cancel the order, suspend the execution of the order, limit individual payment or delivery methods, request additional confirmation of data, prepayment or other confirmation of the buyer's good faith, as well as refuse further customer service without explaining the reasons within the limits not prohibited by law.

Force majeure

The store is not liable for full or partial failure to fulfill its obligations if such failure is a result of force majeure circumstances, including, but not limited to, acts of war, logistics blockages, customs delays, government restrictions, strikes, accidents, technical failures, supply disruptions, power outages, communication failures, epidemics, natural disasters, or other circumstances that the store could not reasonably foresee or control.

Personal data

By placing an order, the buyer agrees to the processing of his personal data to the extent necessary for order processing, delivery of goods, communication regarding the order, payment, warranty consideration and other support of the order.

The store does not transfer personal data to third parties, except for delivery services, payment partners, suppliers or other persons involved in the fulfillment of the order, and only to the extent necessary for the proper fulfillment of such order.

Intellectual property

All texts, photos, descriptions, graphic elements, site structure and other materials posted on DeviceUA belong to the store or are used on legal grounds. Any copying, reprinting, mass use, parsing or other use of site materials without prior written permission is prohibited, except as expressly permitted by law.

Change of conditions

DeviceUA store may change these rules at any time. Further use of the site or placing orders means automatic agreement with the new version of the terms.

Final provisions

All legal relations between the buyer and DeviceUA are governed by the laws of Ukraine, unless otherwise follows from the nature of international delivery, import or mandatory regulations of the country of destination.

If any provision of these Terms is held to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Placing an order, making a prepayment, payment, confirming the order or actual acceptance of the goods means the buyer's full and unconditional agreement with these Terms.
